MasterCard-Saigontourist Promotion - Terms and Conditions

I. Eligibility

1. The MasterCard Saigontourist Promotion is open to all MasterCard branded cards are hereinafter each referred to as an “Eligible Card”.

II. General

1. MasterCard has the sole and absolute discretion to exclude any cardholder (including but not limited to any cardholder who does not operate their accounts in a satisfactory manner as determined by the relevant issuing banks in their sole discretion) from the Promotion without any obligation to furnish any notice and/or reason.
2. By participating in the Promotion, each participant fully and unconditionally agrees to these Terms and Conditions and accepts that the decision of MasterCard and its external auditors regarding the Promotion and all matters related to it, including without limitation, the interpretation of these Terms and Conditions, is final and binding and no queries shall be entertained.
3. MasterCard and Saigontourist Holding Company reserve the right to vary the Terms and Conditions herein at any time at their absolute discretion without notice.

III. The Offer

The Offer refers to One complimentary night stay at the Participating Hotel when any Eligible Cardholder purchase a minimum of a consecutive Three-Night Stay at the Participating Hotel using the Saigontourist website, www.saigontourist.net or www.etravelvietnam.com between 1 July 2010 - 30 June 2011 (“Promotion Period”). The following Terms and Conditions apply to The Offer:

1. The promotion cannot be exchanged for cash or used in conjunction with any other offer, promotion or discount.
2. Rooms are subject to availability at time of reservations
3. Promotion is only valid for purchases at prevailing internet room rates
4. Bookings must be made via the Saigontourist website at www.saigontourist.net or www.etravelvietnam.com
5. MasterCard cardholders must quote MasterCard – Saigontourist Promotion when making reservations.
6. All payment must be made by MasterCard upon reservation and check out
7. Complimentary Night Stay must be consumed consecutively with the purchased stay.
8. Promotion is valid for all MasterCard cardholders
9. Promotion is valid for maximum of one complimentary night stay per cardholder each booking/time.
10. Promotion is valid up to a maximum of 50 complimentary night stays per participating hotel per month and while stock lasts and this can be adjusted by the joint approval of MasterCard and Saigontourist.
11. Participating Hotels’ black-out dates apply.
12. MasterCard does not assume any responsibility for the products and services offered under the offers stated herein. The products are sold and services are provided solely by Saigontourist and the Participating Hotels, under such Terms and Conditions as determined by Saigontourist and MasterCard accepts no liability whatsoever in connection with such products and services. MasterCard has not certified the products and services and under no circumstances shall the inclusion of any product or service under the offers stated herein be construed as an endorsement or recommendation of such product or service by MasterCard.

IV. Miscellaneous

1. MasterCard, its members, associated companies and advertising & promotion agencies and their respective directors, officers, employees and agents shall not, to the extent permissible by law, be liable in any way whatsoever in respect of the following:

• Any application that is damaged, lost stolen, misdirected or otherwise not received;
• Inaccurate entry information, howsoever caused;
• Any amount charged to a participant’s account in the course of participating in the Promotion;
• Virus or other corruption, technical or mechanical error or failure, human error, negligence or unauthorised human intervention in any part of the entry processes or the operation or administration of the Promotion;
• Any liability, loss, injury, claim or damage (including without limitation death or personal injury) incurred or suffered by any participant or other person which may be caused, directly or indirectly, in whole or in part, from any participation in the Promotion. Each participant shall indemnify and not hold responsibilities on MasterCard, its members, associated companies and agencies and their respective directors, officers, employees and agents against any claim, action, proceeding, judgment, damage, loss, expense or liability made against or incurred by the same in connection with such participant’s participation in the Promotion.

2. If any of the provisions of these Terms and Conditions becomes or is invalid, illegal or unenforceable in any respect under any law, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired.

3. These Terms and Conditions shall be governed by the laws of England and participants of the Promotion agree to submit to the non exclusive jurisdiction of the courts of Singapore.
